Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Tracer website, dashboard, API, and command-line tools (the “Service”) provided by Tracer AI, Inc. (“Tracer”, “we”, “us”), a Delaware corporation. By using the Service you agree to these Terms.
1. The Service
Tracer helps you route classification and related workloads between lightweight models and larger language models, and to observe and analyze that traffic. The Service is offered on an ongoing basis and may change as we improve it.
2. Accounts
You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be at least 16 and able to form a binding contract.
3. Acceptable use
You agree not to:
- use the Service unlawfully or to violate the rights of others;
- upload content you do not have the right to submit;
- attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
- use the Service, or any model output obtained through it, in violation of a model provider’s terms or acceptable-use policy, including any restriction on using outputs to train, fine-tune, distill, or build competing models;
- resell or abuse the Service or its underlying model providers.
4. Your content
You retain ownership of the traces, inputs, and other content you submit (“Your Content”). You grant us a limited license to host, process, and transmit Your Content to provide the Service to you, including sending it to the model providers you select and, where you use training features, training routing models for your own account. We do not use Your Content to train models for other customers.
5. Models, third-party providers, and your responsibility
The Service lets you route requests to model providers you choose (such as OpenAI, Anthropic, and Google). Your use of those models, and of any output they produce, is governed by each provider’s own terms and acceptable-use policies. You are solely responsible for complying with those terms, including any restriction on using model outputs to train, fine-tune, distill, or build competing models or services. Tracer is a routing and observability tool: it does not grant you any rights in third-party models, and it does not authorize, endorse, or accept responsibility for any use that violates a provider’s terms or applicable law. You assume all responsibility and liability for the inputs you submit, the providers you select, the outputs you receive, and your downstream use of them.
6. Fees and credits
New accounts may include a limited free usage allowance. Where paid usage is offered, prices and billing terms will be presented before you incur charges. Allowances and credits have no cash value and may expire.
7. Open-source components
Parts of Tracer are published as open-source software under their own licenses. Those licenses govern your use of those components and are not superseded by these Terms.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any routing decision or model output will be accurate or suitable for your purposes.
9. Limitation of liability
To the maximum extent permitted by law, Tracer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred US dollars.
10. Indemnification
You agree to indemnify and hold Tracer harmless from claims arising out of Your Content or your use of the Service in violation of these Terms or applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware.
13. Changes
We may update these Terms from time to time. Material changes will be reflected by updating the date above. Continued use after changes take effect constitutes acceptance.
